
Affidavits in Japan
The process whereby affidavits are created in Japan is as follows:
1) The lawyer swears an oath that the contents of the document are true.
2) The lawyer signs the document in the presence of a notary*.
3) The notary then certifies and authenticates that the lawyer did indeed sign it.
*Notaries around the world can generally be divided into two types based on their roles and authority. The first type is the American-style "notary public", whose duties are limited to the authentication of documents and the preparation of affidavits. The second type is the Latin-style "notary", whose duties include not only the authentication and affidavit preparation but also the creation of notarized deeds and other formal legal documents. Japan's notary system belongs to the Latin-style notary system. Thus, our office uses the word " notary", not "notary public".
Typical process for creating an affidavit through us
- Please contact us through e-mail or telephone, and inform us of the summary of your required affidavit.
- After inquiring about the necessary details, we will provide an estimate of the total fees.
- The draft of a delegation contract between the client and our office will be sent by e-mail.
- The contract above will be made via e-mail, and the deposit will be paid by the client.
- The contents of affidavits will be discussed and determined via e-mail.
- We will finalize the affidavit at the notary office.
- The affidavit will be sent to the client by international post.
- The fees and incidental expenses will be settled.

Fees and Costs
The contents of affidavits vary from simple to complex.Thus, lawyer's fees for creating affidavits depend on the content.We will provide a quote in advance.There is no cost for its provision.
A standard affidavit usually costs around 150,000~250,000 yen, while a complicated affidavit costs around 400,000~600,000 yen.
In addition, notary office fees and international post-delivery fees will also be charged to the client.
The fee for notarization of an affidavit written in a foreign language is 17,000 yen per document (per one signature by the notary).
